Legal matters

In the case of electronic publication on the OPUS server of the University Library of the European University, all rights remain with the author. The author transfers the simple distribution right to the University Library. This means that the authors retain the right to publish the work elsewhere. A reference to a print version published in parallel can be made on the frontdoor page of the electronic version (see also → Open Access and your publishing contract).

The authors assure in a signed declaration of consent (in German),

a) that they transfer to the University Library of the European University Viadrina the right to publish the work on the Internet and

b) that the rights of third parties are not infringed by the publication and

c) that the German National Library may, if necessary, mirror the publication and make it publicly available on its servers, in the case of dissertations additionally

d) that the work corresponds to the work released for publication and is identical to the printed copies submitted at the same time

.

Use

The Copyright Act (UrhG) applies to documents that are offered in electronic form via data networks if and insofar as the author or rights holder has not modified the exploitation rights by granting a Creative Commons licence.

According to Section 53 of the Copyright Act, readers are authorised to make personal copies and printouts for their own scientific or non-commercial use.

Further use requires the express prior written authorisation of the author/author.

If the work is subject to a Creative Commons licence, a link on the front door of the electronic resource refers to the applicable terms of use.

The user is responsible for compliance with the legal provisions. They may be held liable in the event of misuse.
